Terms and Conditions – Vemorina

These Terms and Conditions apply to all offers, orders and agreements concluded via www.vemorina.com and form a legally binding agreement between the customer and Vemorina.

2. Applicability

These Terms and Conditions apply to all offers, purchases and agreements concluded via the Vemorina website.

By placing an order, the customer explicitly acknowledges having read, understood and accepted these Terms and Conditions.

Any deviation from these Terms and Conditions is only valid if expressly agreed in writing by Vemorina.

3. Offers and product information

All product descriptions, images, pricing and other information on the website are provided with the greatest possible accuracy. However, obvious errors, inaccuracies or omissions do not bind Vemorina.

Product images are illustrative and may differ slightly from the delivered product.

Offers are valid while stocks last and may be modified or withdrawn at any time.

4. Formation of the agreement

An agreement is concluded only after the customer has placed an order and Vemorina has confirmed the order electronically.

Vemorina reserves the right to refuse or cancel any order in case of suspected fraud, incorrect pricing, technical errors, stock unavailability or other legitimate reasons.

5. Prices and payment

All prices are stated in euros and include applicable VAT, unless stated otherwise.
Shipping costs are displayed separately during checkout.

Payment must be completed using the payment methods offered on the website.
The goods remain the property of Vemorina until full payment has been received.

6. Delivery and execution

Delivery is carried out in accordance with the Shipping Policy as published on the website.

Estimated delivery times are indicative and not binding.
Risk passes to the customer upon physical delivery of the goods.

7. Right of withdrawal and returns

Customers have a statutory right of withdrawal in accordance with Belgian and EU consumer law.

The conditions, procedure and limitations applicable to returns are set out in the Returns Policy, which forms an integral part of these Terms and Conditions.

8. Use of products

Products are intended for personal use only.

Fit, comfort and performance may vary depending on individual characteristics.
Product information does not constitute medical, ergonomic or professional advice.

Any use beyond normal assessment of size and fit may affect the right of return.

9. Liability

To the maximum extent permitted by applicable law, Vemorina shall not be liable for indirect or consequential damages, including but not limited to loss of profit, loss of data or loss of business.

Vemorina’s liability is in all cases limited to the amount paid by the customer for the product concerned, except in cases of gross negligence, fraud or mandatory statutory liability.

10. Force majeure

Vemorina shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to strikes, transport disruptions, supply chain failures, governmental measures, pandemics or natural disasters.

11. Complaints

Complaints regarding the execution of the agreement must be submitted in writing via contact form within a reasonable period after the customer has discovered the issue.

Vemorina will respond to complaints within a reasonable timeframe.

12. Intellectual property

All intellectual property rights relating to the website, products and content belong to Vemorina or its licensors.

Unauthorized use, reproduction or distribution is prohibited.

13. Abuse and fraud

Vemorina reserves the right to refuse orders, suspend accounts or withhold refunds in case of suspected abuse, fraud, excessive returns or misuse of policies.

14. Modification of the terms

Vemorina reserves the right to amend these Terms and Conditions at any time.
Amended terms apply only to orders placed after publication.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

16. Governing law and jurisdiction

These Terms and Conditions are governed exclusively by Belgian law.

In the event of a dispute, the courts of the judicial district of Limburg, Hasselt division, shall have jurisdiction, without prejudice to mandatory consumer protection rules.
